By accepting, I declare that:
I have read these terms and conditions and know and understand the contents thereof.
Whereas the Future Global Leaders (FGL or Club) is designed for the purpose elaborated more fully below, and
Whereas a member would like to join the Club and acknowledges and agrees to be bound by the terms and conditions listed herein.
As a member you unequivocally agree and consent to the following:
1. Membership
This agreement forms a legally binding agreement between the member and FGL and governs the member’s access to the Clubs (Membership Services).
By accessing or using any of the Membership Services, you agree to be bound and abide by this agreement and any amendments thereto from time to time. If you do not agree to these terms and conditions, please immediately seize to use of any of the Membership Services.
2. Membership Eligibility
Members must have achieved an average aggregate B or Level 6, from 70% up submitted results that are stamped and signed by the school principal.
FGL is bound by school results and does not have any ability to adjust the official school results. A criminal record will prevent any person to become a member or to continue to be a member.
3. Membership Design
Members shall be star rated as follows:
∙ seven star members for leaners who achieve 90% to 100%
∙ five star members for leaners who achieve 80 to 89%
∙ four star the members for leaners who achieve 75 to 79%
∙ three star members for learners who achieved 70 to 74%
Results must be uploaded at the end of each academic year, based on the results, members will be rerated according to their latest performance.
FGL members will be given a welcome pack containing FGL branded items to be used. These shall not be shared for use with non-members of the FGL. Members will use the correct branded items for each academic year where applicable.
Member Log in details that are provided should be used solely for your personal purpose and should not be shared with anyone. This will be your unique number that will provide you access to free workshops and seminars registrations, online store, online maths and science competitions, resource center. etc.
4. Membership Classification
Membership classifications will evolve to include the following categories:
∙ FGL junior ambassadors (grade 1 to 7)
average symbol A for Maths and English
∙ FGL members (grade 8 to 12)
Average B to average A
∙ FGL ambassadors (tertiary students)
Admission criteria is matric certificate that qualifies your university admission ∙ FGL senior ambassador (post graduate students) - junior degree certificate ∙ FGL professional (Members with professional qualifications) members of a professional body ∙ FGL alumni (retired member of the FGL post five years professional qualification 6 Termination
This agreement may be immediately terminated in the event that there is a breach of any term of this agreement by the member.
5. Limited Licence
Member acknowledges and agrees that FGL's name, services, and any logos, designs, text, graphics, software, content, files, materials, and any other intellectual property rights contained herein, including, without limitation, any copyrights, patents, trademarks, proprietary, and all other rights thereof are owned by FGL or its affiliates, licensors or suppliers.
Member agrees not to do anything inconsistent with FGL’s ownership of all of the intellectual property referred to herein. Member further agrees that there are no rights, title, or interest in or to any Membership Services, except as stated or provided in this agreement.
For any Membership Services which enable you to use any software, content, or any material owned and licensed by FGL, is limited, revocable, non-exclusive, non-sublicensable, non-transferable license to access and use the Membership Services. The Membership Services are for personal use and non commercial use only.
6. Restrictions
You are prohibited from, and expressly agree that you will not:
∙ circumvent, or disable any content protection system or digital rights management technology used with any Membership Services.
∙ Remove identification, copyright or other proprietary notices in any of the membership services.
∙ Access or use any Membership Services in an unlawful or unauthorized manner or in a manner that suggests an association with its content, products, services or brands unless you have a written agreement with us that allows you for such activity.
∙ Use, alter, copy, modify, store, sell, reproduce, distribute, republish, or exploit any Membership Services or any part thereof, except as expressly authorized in this agreement all as part of the Membership Services provided to you.
∙ Introduce a virus or other harmful components or otherwise tamper with, impair or damage any Membership Services or connect the network or interfere with any person’s use or enjoyment of any of the Member Services.
∙ Access, monitor, or copy any element of Membership Services using a robot, spider, scraper or other automated means or manual process without express written permission. ∙ Sell, resell or make commercial use of the Membership Services, unless you have a written agreement with us that expressly allows for such activity.
7. Third Party Services
Certain Membership Services may integrate, be integrated into or be provided in connection with third party websites, services, content, and or materials (Third Party Services). We do not control any Third Party services. We additionally make no claim or representation regarding the Third Party Services and accept no responsibility for the quality, content, nature or reliability of Third Party Services. There is no implied affiliation, endorsement, or adoption by FGL of these Third Party Services and we shall not be responsible for any content provided by or through these Third Party Services. You should read the terms of use and legal agreements that apply to those Third Party Services.
8. Member Consents
Member agrees to hold FGL, its owners, its affiliate, and representatives, harmless from damage, whether tangible all intangible, that may happen to a member while participating in the Membership Services.
Member agrees that FGL and its membership programs do not provide guarantees of any kind.
Member agrees that their results or outcomes that occurred during their membership, whether positive or negative, will be the effects of member’s own personal choices.
Member agrees and verifies that all of the information that they have given to FGL and its representatives is accurate, up to date and without omission of any requested information.
Member agrees to notify FGL of any changes or upcoming changes concerning their personal information.
9. Assumption of Risk
Member agrees and understands that their participation in the Membership Services may involve risks. These risks may lead to tangibles or intangible harm and the member agrees that these risks may result not only from their own actions but from the actions of others. With the knowledge and understanding of these risks, a member chooses of her own will and volition, to continue participating in the Membership Services.
10. Representation
Member confirms that they are over 18 years or that their parent or guardian has consented to and enter into this agreement.
11. Entire Agreement
This agreement constitutes the entire understanding between the member and FGL with respect to any and all use of the activities of the Membership Services. This agreement supersedes and replaces all prior agreements or understandings, written or oral regarding their relationship.
12. Dispute Resolution
In case of a dispute between a member and FGL relating to or arising out of this agreement, the parties shall attempt to resolve the dispute amicably and in good faith within 14 (fourteen) days from the date in which the dispute arose. In the even that the said dispute is not resolved, any party may refer the matter to arbitration according to the rules of the Arbitration Foundation of South Africa (AFSA). The provision of this clause shall not prevent any party to approach a competent court to grant and interim remedy pending the finalization of the arbitration proceedings.
13. Notices
All notices, requests, claims, demands, waivers, or any other communication hereunder “(Notice”) shall be in writing addressed to the parties at the addresses that they have provided in the FGL Portal. All Notices shall be delivered by email or at the address which the parties may designate to each other. An emailed Notice shall be deemed to have been received by the receiving party on the same date in which it was sent. A physically delivered Notice shall be deemed to have been received by the receiving party on the same date in which it was delivered.
14. Governing Law
This agreement shall be governed and construed according to the laws of the Republic of South Africa.
15. Severability
If any part of this agreement is held to be invalid or unenforceable by a court of law or competent arbitrator, the remaining parts shall be enforceable in their terms including all the remaining parts of this agreement.
